Terms of Service

Please read these terms carefully before using WorkFace. By using our app, you agree to be bound by these terms.

1 Acceptance of Terms

By downloading, installing, or using WorkFace ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and CraftingHR ("we," "us," or "our") regarding your use of the App.

Agreement to Terms

Your use of WorkFace signifies that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

2 Description of Service

WorkFace is a face recognition attendance application that provides:

  • Face-based attendance tracking (punch in/out)
  • On-device face recognition processing
  • Local storage of attendance records
  • Attendance statistics and reporting
  • CSV export functionality
  • Optional webhook integration for data sync

Privacy by Design

WorkFace is designed as an offline-first application. All biometric data is processed and stored locally on your device and is never transmitted to our servers.

3 Account Registration

To use WorkFace, you must:

  1. Sign in using a valid Google account
  2. Be at least 13 years of age (or the minimum age in your jurisdiction)
  3. Provide accurate and complete information
  4. Maintain the security of your account credentials

You are responsible for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

4 Biometric Data Consent

By using WorkFace's face recognition features, you acknowledge and consent to:

  • The collection and processing of your facial features for attendance tracking
  • The storage of facial feature templates on your device
  • The use of your device's camera for face detection and recognition

Important Notice

Your biometric data (facial features) is processed entirely on your device and is never uploaded to any server. You may delete your biometric data at any time through the app settings.

Organizational Use

If you are using WorkFace on behalf of an organization or employer:

  • You confirm that you have obtained necessary consents from individuals whose biometric data will be processed
  • You are responsible for complying with applicable biometric data privacy laws (including BIPA, GDPR, etc.)
  • You will provide appropriate notice to individuals about the collection and use of their biometric data

5 Acceptable Use

You agree to use WorkFace only for lawful purposes and in accordance with these Terms. You agree NOT to:

  • Use the App in any way that violates applicable laws or regulations
  • Attempt to reverse engineer, decompile, or disassemble the App
  • Attempt to bypass any security features of the App
  • Use the App to collect biometric data without proper consent
  • Use the App for surveillance or monitoring without proper authorization
  • Modify, adapt, or hack the App
  • Use the App to transmit malware or other harmful code
  • Interfere with or disrupt the integrity of the App

6 Webhook Integration

If you choose to use webhook integration:

  • You are responsible for the security of your webhook endpoint
  • You acknowledge that attendance data (not biometric data) will be transmitted to your specified endpoint
  • You must use HTTPS endpoints for secure data transmission
  • You are responsible for compliance with data protection laws regarding transmitted data

We are not responsible for any data loss, breach, or misuse that occurs at your webhook endpoint.

7 Intellectual Property

The App and its original content, features, and functionality are owned by CraftingHR and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the App for its intended purpose. This license does not include:

  • The right to modify or create derivative works
  • The right to distribute, publicly display, or publicly perform the App
  • The right to sublicense or transfer your rights

8 Data Ownership

You retain ownership of all data you create or input into WorkFace, including:

  • Attendance records
  • Employee information
  • Exported reports

Your biometric data remains under your control and is stored only on your device. We do not claim any ownership or access rights to your biometric data.

9 Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • IMPLIED WARRANTIES OF MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
  • ACCURACY OR RELIABILITY OF FACE RECOGNITION

We do not warrant that:

  • The App will function uninterrupted or error-free
  • Face recognition will be 100% accurate
  • The App will meet your specific requirements
  • Any errors in the App will be corrected

Face Recognition Accuracy

Face recognition technology has inherent limitations. We recommend implementing backup attendance methods for critical scenarios. You acknowledge that recognition accuracy may vary based on lighting, camera quality, and other environmental factors.

10 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CRAFTINGHR SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, data, use, goodwill, or other intangible losses
  • Damages resulting from unauthorized access to your data
  • Damages resulting from face recognition errors or inaccuracies
  • Any damages exceeding the amount you paid for the App (if any) in the twelve (12) months preceding the claim

Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability, so some of the above limitations may not apply to you.

11 Indemnification

You agree to indemnify, defend, and hold harmless CraftingHR and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from:

  • Your use of the App
  • Your violation of these Terms
  • Your violation of any third-party rights, including privacy rights
  • Your failure to obtain proper consent for biometric data collection

12 Termination

We may terminate or suspend your access to the App immediately, without prior notice, for any reason, including:

  • Breach of these Terms
  • Violation of applicable laws
  • Conduct that we determine is harmful to other users or our interests

Upon termination:

  • Your license to use the App will immediately cease
  • You may export your attendance data before termination
  • Your locally stored data remains on your device until you delete it or uninstall the App

13 Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

  • Posting the updated Terms within the App
  • Updating the "Effective Date" at the top
  • Providing an in-app notification for significant changes

Your continued use of the App after changes become effective constitutes acceptance of the revised Terms.

14 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which CraftingHR is registered, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration or in the courts of competent jurisdiction.

15 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

16 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and CraftingHR regarding your use of the App and supersede all prior agreements and understandings.
